I authorize BigBoss Roofing LLC to inspect my property and discuss available service, repair, replacement, and insurance claim documentation options. I understand this intake form is not a contract for work.

This Contingency Agreement ("Agreement") is entered into between the property owner identified below ("Property Owner") and BigBoss Roofing LLC ("Contractor") for the purpose of inspecting the property for storm-related damage and, if applicable, performing repair or replacement work that may be covered in whole or in part by the Property Owner's insurance claim.

1. Scope of Engagement
Contractor agrees to inspect the Property for visible damage, prepare an estimate of the scope and cost to repair or replace damaged components, and provide documentation that may be submitted to the Property Owner's insurance carrier.
2. Contingency on Approved Claim
Property Owner agrees that this Agreement is contingent on the Property Owner's insurance carrier approving a claim that covers the scope of work identified by Contractor. If no claim is approved, this Agreement shall be void and neither party shall owe the other any compensation, except for emergency or out-of-scope work expressly authorized in writing.
3. Authorization
Property Owner authorizes Contractor to perform the work approved by the insurance carrier, less the Property Owner's deductible and any non-recoverable amounts as set forth in the insurance estimate. Total contract price shall equal the approved insurance scope plus any agreed-upon supplements and change orders.
4. Insurance Claim Support
Contractor will provide documentation and general claim support consistent with applicable law. BigBoss Roofing LLC is NOT a public adjuster, attorney, insurance company, or claim settlement authority. Contractor does not guarantee coverage, claim approval, payment, supplements, or the outcome of any appraisal.
5. Materials & Workmanship
Materials shall be of the type and quality customary for residential or commercial roofing in the Dallas-Fort Worth area, unless otherwise specified in writing. Workmanship shall conform to manufacturer specifications and applicable codes.
6. Right of Rescission
Property Owner may cancel this Agreement without penalty within the time period required by applicable state law from the date the Property Owner is notified in writing that the insurance carrier has denied coverage in whole or in part for the loss, by written notice delivered to Contractor at the contact information on this Agreement.
7. Entire Agreement
This Agreement, together with any executed Work Order, Change Order, and final approved insurance scope, constitutes the entire agreement between the parties. Any modification must be in writing and signed by both parties.

By signing below, I accept the Terms & Conditions of this contract / Work Order. Any changes to this contract / Work Order must be submitted in writing and agreed upon by both parties. A Change Order must be attached to continue with changes.

This Change Order modifies the original Work Order and/or Contingency Agreement between the property owner identified below and BigBoss Roofing LLC. Once signed by both parties, the changes described herein are incorporated into the original agreement.

BigBoss Roofing LLC may offer a workmanship warranty on completed scopes. Manufacturer warranties are governed by the manufacturer's written terms and registration requirements. Warranty terms and length vary by project, product, and any applicable exclusions. Refer to the written warranty issued at project closeout for full terms.

Property Owner authorizes Contractor to communicate with the following parties for the purpose of providing documentation, photos, estimates, scope, and status updates related to the work performed or to be performed at the property identified above:
Limits of Authorization
This authorization does NOT permit Contractor to:

BigBoss Roofing LLC is not a public adjuster, attorney, insurance company, or claim settlement authority.
Duration
This authorization remains in effect until written revocation by Property Owner, completion of the project, or twelve (12) months from the date signed, whichever occurs first.

Final Sign-Off

This Master Service Agreement ("MSA") is entered into between BigBoss Roofing LLC, a Texas limited liability company ("Contractor"), and the property owner identified below ("Owner"). The MSA governs the general terms of any roofing, siding, gutters, or exterior services performed by Contractor at the property described herein. Specific scope, materials, and pricing for each project shall be set forth in a Work Order, Cash Bid, or Change Order incorporated into this MSA by reference.

1. Services
Contractor will provide roofing, repair, replacement, gutters, siding, exterior, storm damage assessment, and related services as described in each Work Order, Cash Bid, or Change Order executed under this MSA. The parties may execute one or more Work Orders during the term of this MSA.
2. Pricing & Payment
Pricing for each project shall be set forth in the applicable Work Order or Cash Bid. Insurance scope shall equal the approved scope of loss plus any agreed supplements. Owner shall pay Contractor according to the payment terms identified in the Work Order and the Final Invoice. Owner shall not pay Contractor with funds drawn on or endorsed by a third party unless agreed in writing.
3. Materials & Workmanship
Materials shall be of the type and quality identified in the Work Order. Workmanship shall conform to manufacturer specifications and applicable building codes. Substitutions may be made if materials are unavailable, with notice to Owner where reasonable.
4. Warranty
Contractor offers a workmanship warranty on installed roofing systems for the duration stated in the project closeout warranty document. Manufacturer warranties are governed solely by the manufacturer's written terms. Warranty does not cover damage from acts of God, subsequent storms, owner alterations, mechanical or impact damage from third parties, lack of routine maintenance, or pre-existing conditions outside the installed scope.
5. Insurance Claim Support
Contractor may inspect the property, document visible damage, and provide a written estimate to Owner for use with Owner's insurance carrier. Contractor is NOT a public adjuster, attorney, insurance company, or claim settlement authority. Contractor does not guarantee coverage, claim approval, payment, supplement approval, or appraisal outcome.
6. Permits & Code
Contractor shall pull required municipal permits where applicable and shall perform the work in compliance with applicable building codes in effect on the date of the Work Order. Owner shall provide reasonable access to the property and utility service required for the work.
7. Liability & Insurance
Contractor maintains general liability insurance and shall provide proof upon written request. Contractor shall not be liable for delay or damage caused by weather, supply disruption, acts of God, code authority action, Owner-directed change, or other circumstances outside Contractor's reasonable control. In no event shall either party be liable to the other for indirect, consequential, or punitive damages.
8. Indemnification
Each party shall indemnify and hold harmless the other from claims caused by that party's gross negligence or willful misconduct in connection with the work, subject to the limits of available insurance.
9. Default & Remedies
If Owner fails to pay amounts when due, Contractor may suspend performance and pursue all rights and remedies available under law, including filing a mechanic's lien on the property where permitted by law.
10. Right of Rescission
Owner may cancel any Work Order or related agreement without penalty within the time period required by applicable state law from the date the Owner is notified in writing that the insurance carrier has denied coverage in whole or in part for the loss.
11. Dispute Resolution
The parties shall attempt to resolve any dispute through good-faith discussion. If unresolved, disputes shall be governed by Texas law and resolved exclusively in the state or federal courts located in Tarrant County, Texas.
12. Entire Agreement
This MSA, together with each executed Work Order, Cash Bid, Change Order, and Final Invoice, constitutes the entire agreement between the parties. Any modification must be in writing and signed by both parties. If any provision is found unenforceable, the remainder shall remain in full force and effect.

This Deductible Payment Plan documents the schedule by which the property owner ("Owner") will pay the insurance deductible to BigBoss Roofing LLC ("Contractor") for an insurance-claim project. The deductible remains the financial responsibility of the Owner.
Important Notice
Texas law (Tex. Ins. Code sections 27.01 et seq.) and the laws of many other states make it illegal for a contractor to waive, absorb, rebate, or pay an insurance deductible. Owner must pay the deductible. This Payment Plan does not waive, reduce, or rebate the deductible; it only schedules payment of it.
